Terms of use

What this is

These terms cover your use of the Spin Wheel app for Android. Installing it or using it means accepting them. If you do not accept them, do not install it — and if you already have, uninstalling it ends this agreement with nothing left owing on either side.

You are given permission to use the app on devices you control, for your own purposes — personal, professional or in a classroom. That permission is not exclusive and cannot be transferred. The app itself, its ready-made wheels, its design and its code remain ours.

The app is not directed at children under 13. Using it with a class is a teacher’s use of it, and these terms are with the teacher.

What it is not

The app is a random picker. It is not a gambling product, a lottery, a raffle service or a prize-draw operator. It takes no stakes, holds no entries, awards nothing and pays out nothing, and no money passes through it in either direction.

It is also not a certified or audited draw. The winner is chosen by the ordinary random number generator built into the phone, which is the right tool for deciding what to eat and the wrong one for anything that has to be provably fair to somebody outside the room. There is no certificate, no audit trail and no record we could produce if asked, because a spin never reaches us.

So if you are running a prize promotion, a giveaway, a ballot or anything a regulator, a platform or an employer has rules about, meeting those rules is yours to do. A spin is not evidence that a draw was fair, and we cannot verify, reproduce or vouch for one afterwards.

Fairness, and where it stops

Weights are exact. The winner is drawn first, in proportion to the weights you set, and only then does the wheel turn to it — so an option weighted three times heavier really is picked three times as often, rather than landing wherever a random angle happened to stop. Elimination mode removes each winner, so a name cannot come up twice in a draw that should not repeat one.

That is a statement about the arithmetic, not about your situation. The app does not know what you are deciding, who it affects, or whether the options you typed were the right ones to put in front of it. It has no view on whether an outcome is fair, reasonable or acceptable to the people it lands on. Deciding something by spinning for it is your choice, and the result is yours to stand behind.

Your wheels are yours

The wheels you build, the options on them and your spin history belong to you. They stay in the app’s own private space on your phone and are never sent to us — we run no servers for them to be sent to, which also means we cannot see, recover or restore anything you make.

A backup is a file you save yourself, wherever you choose to put it. From that moment it is your file: keeping it, moving it between phones and protecting it are yours to do, and if it is lost or overwritten we have no copy of it. Uninstalling the app deletes everything the app holds.

You are responsible for what you type into a wheel. If you put other people’s names on one — a class register, a team, a staff rota — that is your call to make and yours to answer for. It does not reach us either way.

How the app is paid for, and that this can change

The app is free to download and every feature in it is free to use. There is no subscription, no pro version and nothing behind a paywall. It is funded by advertising shown inside the app, served by Google, and what Google collects in order to do that is set out in the privacy policy rather than here.

You can also choose to watch one short video advertisement and have advertising switched off for a day. That is an offer rather than a requirement: the app is complete without it, and declining costs you no feature.

We may change how the app is funded in a future version — by changing or removing advertising, or by introducing paid features. If we do, the change arrives in an app update, this page is updated with it, and the privacy policy and the app’s Data safety information on Google Play are updated at the same time if what is collected changes. Nothing you have already installed starts costing money or showing advertising it did not show when you installed it.

Using it fairly

• Do not decompile, modify or redistribute the app, or publish its ready-made wheels or its design as your own.
• Do not interfere with the advertising that pays for it, or produce ad activity that is not genuine use — automated taps, or anything whose purpose is to generate revenue or ad-free time rather than to spin a wheel.
• Do not present a spin as a certified, audited or independently supervised draw, to anyone.
• Do not use the app to run anything that is unlawful where you are, including a draw for money in a place that does not permit one.

Availability

Everything but the advertising works with no connection at all, so the app keeps working whether or not anything of ours does. We may stop publishing updates, or remove the app from Google Play, at any time. A copy already installed keeps working; we do not disable it remotely, and there is no account to close.

The home-screen widget depends on your launcher supporting widgets and on Android letting it refresh, both of which are the phone’s to decide rather than ours.

What we are responsible for

The app is provided as it is. We do not promise that it is free of defects, that it will always be available, or that a spin will always complete.

We are not liable for a loss that follows from a decision made with the app, or from a draw run with it — who was picked and who was not, what was promised to whoever won, or any dispute about either. That is the whole reason the sections above say plainly what a spin is not.

We are not liable for wheels you lose. There is no copy of them anywhere but your phone and whatever backup file you made, which is the same fact that lets the privacy policy say we collect nothing.

None of that touches the rights you have as a consumer. Nothing on this page excludes or limits any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, and for fraud. Where the law of your own country gives you rights that these terms appear to reduce, your rights win and this paragraph is the one that governs.

You have paid us nothing, and we hold nothing of yours: there is no account, no subscription and no data of yours on any server of ours. Where a limit on liability applies and the law allows one to be set, it is the amount you have paid us for the app, which is nothing.

Changes to these terms

We may change these terms. When we do, the date at the top of this page changes, and the change takes effect for the version of the app released alongside it.

It does not take effect for the copy already on your phone. That version keeps behaving the way it did when you installed it and stays governed by the terms it shipped under, so you are not bound by a change simply for carrying on using what you already have. A change reaches you only through an update, and you can decline an update or uninstall the app. Continuing to use the app after you have installed an update is what indicates that you accept the terms that came with it.
